How to file consumer complaints
in consumer forum.
You can present and
defend your case in consumer courts without a lawyer. The Consumer Protection
Act of 1986 is a central government law applicable to all states in India and
aims to protect the interests of consumers (including investors). If any service
provider in any industry, such as manufacturing, hotel, transportation,
telephone department, electric power department, hospital, bank, educational
institution, etc., has any shortcomings in service, you can seek a quick
solution from the consumer court/forum.
The solution of the
problem.
Consumers do not include
people who obtain goods or services for resale. In addition, consumer courts
cannot consider fees or fees charged by providers. Basic knowledge:
• Don’t make an emotional
decision to go to consumer court, as this may be a slow process and requires a
lot of patience and determination.
• Before deciding to
choose a consumer forum, try to contact consumer organizations (listed below)
to file a complaint on their behalf.
• Before choosing to file a lawsuit in the
Consumer Court, please read the previous judgment. You can also consider
submitting a complaint online.
• Send a notice to the other party before
submitting the petition, so that they have the opportunity to correct their
mistakes.
• You can file a complaint within two years
from the date of the cause of action. However, if the complainant indicates to
the forum that he has a good reason for not filing a complaint within this
period, and the forum records the reasons for his approval of such a delay, he
can receive the complaint after the two-year period.
• The Consumer Protection
Act stipulates that the whistle-blower can appear in court in person or be
represented by an authorized agent or advocate to grant the person the
necessary 100 rupees stamp paper authorization. • The burden of proof for
defending false or misleading guarantees or guarantees will be borne by the
other party.
• The primary responsibility of the consumer
is to obtain a receipt every time he purchases a product or service as proof
that he has paid. In a judgment in favor of consumers, the National Committee
ruled (IV (2005) CPJ 207 (NC)) that the terms and conditions on the receipt are
binding only after the customer signs it. The National Committee also believes
that contract conditions that have not been individually negotiated (even if
the consumer has already signed it) will be considered unfair (and therefore
invalid). If the integrity requirements are violated, it will lead to a serious
imbalance of rights and obligations arising from the contract.
• The Department of Consumer Affairs in Delhi
issued a D.O (D.O No. 11 (11) 99-CPU / 1647, dated 12-22-99), prohibiting the
printing of the condition sold goods will not be withdrawn on the receipts.
Unfortunately, there are still a large number of companies violating D.O. Many
consumers who do not understand the law are misled. If you are not satisfied
with any item you purchased, you can return the item and get a refund, even if
the receipt indicates that the item cannot be recovered once it is sold. If the
store refuses to take it back, please complain to the consumer forum and you
will get your money back.
The District Forum details:
A Consumer Disputes
Redressal Forum to be known as the District Forum was established by the State
Government with the prior approval of the Central Government in each district
of the State under Section 9(a) of the Act. The district forum shall have
jurisdiction to entertain complaints where the value of the goods or services
and the compensation, if any, claimed is less than rupees twenty lakhs. The
District Forum consist of one president (District judge) and two other members
(one of whom is to be a woman).
The specific fee for
filing the case, should be in the form of crossed demand draft or crossed
Indian postal order addressed to “President, District consumer dispute
Redressal Forum”. Cost of filing a case with effect from 10/2/2005:
Up to 1 lakh – Rs.100
Rs.1 lakh – Rs.5 lakh –
Rs.200
Rs.5 lakhs – Rs.10 lakh –
Rs.400
Rs.10 lakh to Rs.20 lakh
– Rs.500
Procedure to file a
petition:
• Jurisdiction is territorial and monetary i.e. either the
office of the respondent or address of the complainant can be used. One must
try to find out at which forum the backlog is less and file accordingly, as per
our convenience.
• Petition must ideally be in English
• Full name & address of the complainant
• Full name & address of the opponent (respondent)
• Information about when and where cause of the complaint
arose.
• Detailed particulars and nature of complaint
• Prayer of reliefs sought including
monetary claims, compensations; and its total value.
• Certified true copies all relevant
documents on which complaint is based and to be attached as Exhibits (in
TRIPLICATE keeping one copy for your record with one extra full set for each of
the opponent/s).
• The complaint can be submitted by hand
delivery or Registered AD or Speed post to the office of the forum. Do not
forget to take receipt of acknowledgement of your copy.

This

said document is furnished at Annexure - I. That the F.D. matured on 25th
January 2011 and the Complainant approached the office of the O.P., on the date
of maturity, for encashing the FD. But
the staff of the Company, on some some pretext or the other delayed making the
payment (Nature of problem encountered).
Hence the Complainant wrote to the O.P., requesting his immediate
intervention. A photocopy of the said
letter is furnished at Annexure - II.
But the Complainant has not been paid his dues till date.
4. (In this paragraph complainant should
explain the grievance, i.e.,whether the loss or damage has been caused by some
unfair trade practice or restrictive trade practice adopted by any trader or
there is some defect in the goods or service or the trader has charged
excessive price for the goods. In case of excessive price one should specify
the details of actual price fixed by or under any law for the time being in
force or as set out on goods and their packing vis-a-vis the price charged by
the trader. Complaint can also be filed against offer for sale of goods
hazardous to life and safety when used. Photocopies of relevant documents must
be attached.)
Example
- That the non-payment of the maturity value of FD, by the O.P., on the
scheduled date, amounts to deficiency in service as defined under sec. 2(1)(g)
of the Consumer Protection Act.
5. (In this paragraph complainant should
highlight what attempts were made by him to set things right, i.e., personal
visits or negotiations, communication in writing if any: whether any legal
notice was got served and/ or whether he has approached any other agency for
redressal like M.R.T.P. Commission, Civil or Criminal Court of competent
jurisdiction; the stage of its proceedings, its outcome, if any, along with
copies (certified preferably) of such proceedings. The nature of response got
from the trader when irregularities were brought to his notice, should also be
disclosed here).
6. (In this paragraph reference may be made
to any other law or rules or regulations of particular procedure which is
applicable to the case and/ or which has been violated by the trader and
consumer's rights under the same. There are incidental statutory obligations,
which traders must fulfill and in case of their failure to do so the case in
prima facie made out and Forum would take cognizance).
7. (In this paragraph complainant should
liquidate the claim in the complaint i.e., upto 20 lacs; 20 lacs to 1 crore; or
above and set out the pecuniary jurisdiction of the Forum/ State Commission/
National Commission, as the case may be. The territorial Jurisdiction should be
highlighted to obviate any formal objection).
8. That the present complaint is being filed
within the period prescribed under section 24A of the Act.

describe the nature of relief he wants to claim, i.e, for removal of defects in
goods or deficiency in service; replacement with new goods; return of the price
